1. Acceptance of Terms
By accessing or using WellnessCopy AI ("the Tool", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use WellnessCopy AI.
These Terms apply to all users of WellnessCopy AI, including free tier users, Starter plan subscribers, and Pro plan subscribers.
2. About WellnessCopy AI
WellnessCopy AI is an AI-powered content generation tool designed to assist health and wellness professionals in creating social media captions, video hooks, newsletter content, lead magnets, and video scripts. The Tool includes a built-in compliance scanning feature that reviews generated content against commonly known FTC and FDA marketing guidelines. WellnessCopy AI is a product of Malone Creative Studio, owned and operated by Nicole Malone, Summerville, South Carolina.
3. Compliance Disclaimer — PLEASE READ CAREFULLY
3.1 Educational Tool Only
WellnessCopy AI's compliance scanner is an AI-powered educational tool. It is designed to flag language commonly associated with FTC and FDA marketing guideline violations based on general patterns. It is NOT:
• A substitute for legal counsel
• A guarantee of regulatory compliance
• A legal opinion or legal advice of any kind
• A comprehensive review of all possible violations in all contexts
3.2 No Legal Guarantee
FTC and FDA marketing guidelines are complex, contextual, and subject to change. The same phrase may be compliant in one context and non-compliant in another depending on your license type, jurisdiction, platform, claims history, and the specific products or services being promoted. WellnessCopy AI cannot account for all variables that affect compliance determinations. A compliance score of 100% does not guarantee that content will not be flagged, investigated, or penalized by the FTC, FDA, or any other regulatory body.
3.3 User Responsibility
You, the user, assume full and sole responsibility for all content you publish, post, distribute, or otherwise make public using WellnessCopy AI generated copy. By using this Tool you acknowledge that:
• You have read and understood this disclaimer
• You are responsible for verifying that your content complies with all applicable laws and regulations
• You will consult a qualified attorney or compliance professional for guidance specific to your practice, license type, and jurisdiction
• WellnessCopy AI and Malone Creative Studio are not liable for any regulatory action, enforcement action, fines, penalties, or legal proceedings resulting from content you publish
3.4 Compliance Override — Undo Function
WellnessCopy AI provides users with the ability to override ("Undo") compliance rewrites suggested by the compliance scanner. By choosing to override any compliance recommendation:
• You explicitly acknowledge that the flagged phrase has been identified as a potential FTC and/or FDA marketing guideline violation
• You assume full personal and professional responsibility for publishing the overridden content
• You release WellnessCopy AI and Malone Creative Studio from any and all liability arising from your decision to publish content that overrides a compliance recommendation
• Your override decision will be logged in our system with a timestamp and associated with your account
3.5 Audit Logging
WellnessCopy AI maintains a secure backend log of all compliance scan events, including whether users accepted or overrode compliance recommendations. This log is maintained for a minimum of three (3) years and may be used in the event of a legal dispute to demonstrate that the Tool provided appropriate warnings and that the user made an informed decision to override those warnings.
4. Limitation of Liability
To the fullest extent permitted by applicable law, WellnessCopy AI and Malone Creative Studio shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
• Your use of or inability to use the Tool• Any content generated by the Tool
• Any regulatory action taken against you as a result of content you publish
• Any decision to override a compliance recommendation
• Any inaccuracy, error, or omission in the compliance scanning featureIn no event shall the total liability of WellnessCopy AI or Malone Creative Studio exceed the amount you paid for the Service in the three (3) months preceding the claim.
5. No Professional Advice
Nothing in WellnessCopy AI, including its compliance scanner, generated copy, or any communications from Malone Creative Studio, constitutes legal advice, medical advice, regulatory advice, or professional advice of any kind. Always consult qualified professionals before making decisions that affect your business, practice, or regulatory standing.
6. Subscription Plans & Billing
6.1 Free Tier
Free tier users receive five (5) content generations at no charge. No payment information is required for the free tier. Free tier access may be modified or discontinued at any time without notice.

6.2 Paid Plans
Starter Plan: $29.00 per month. Pro Plan: $49.00 per month. Paid plans are billed on a recurring monthly basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
6.3 Price Changes
WellnessCopy AI reserves the right to modify subscription pricing at any time. Current subscribers will be notified of price changes with a minimum of 30 days notice before the change takes effect.
7. Intellectual Property
Content generated by WellnessCopy AI is provided for your use in your own marketing and content creation. You retain ownership of any content you create using the Tool. WellnessCopy AI and Malone Creative Studio retain all rights to the Tool itself, including its underlying technology, compliance scanning system, prompts, and interface. You may not reverse engineer, copy, resell, or redistribute the Tool or its underlying systems.
8. User Conduct
By using WellnessCopy AI you agree not to:
• Use the Tool to generate content that is intentionally misleading, fraudulent, or deceptive
• Attempt to circumvent the compliance scanning system
• Use the Tool for any unlawful purpose
• Share your account credentials with others
• Use the Tool to generate content that violates the rights of any third party
9. Privacy & Data
WellnessCopy AI collects and stores user account information, content generation history, and compliance scan logs. This data is used to provide and improve the Service and to maintain the audit trail described in Section 3.5. We do not sell your personal information to third parties. By using the Tool you consent to the collection and storage of this data as described above.
10. Modifications to Terms
WellnessCopy AI reserves the right to modify these Terms at any time. Changes will be posted at malonecreativestudio.com/wellnesscopy-ai-terms with an updated effective date. Continued use of the Tool after changes are posted constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of WellnessCopy AI shall be resolved in the courts of Dorchester County, South Carolina.
